If you received a Bill of Sale & Terms and Conditions of Sale, quote, invoice, appraisal engagement, approval agreement, layaway agreement, or another transaction-specific document from West End Gallery Ltd., that specific document governs the transaction it covers. These Terms of Service set out the general rules for using our website, interacting with the Gallery online, and requesting related services. Where these Terms conflict with a more specific written agreement for a particular transaction or service, the more specific agreement governs that transaction or service.

Full Policy Basics
Overview and Scope:
By accessing or using the website, purchasing from West End Gallery Ltd. online or in-gallery, requesting services, or submitting materials, you agree to these Terms of Service and applicable law. For original artwork purchases, the Bill of Sale & Terms and Conditions of Sale and other transaction-specific documents govern the specific sale, including title, risk, release, shipping, insurance, returns, inspection, and damage claims.
Scope:
These are the general website and service rules. Your sale documents govern the specific transaction.
Using the Site:
You must be the age of majority where required, or have appropriate consent where permitted. You may not use the Site, products, forms, images, documents, or content for any illegal or unauthorized purpose, including infringement, privacy violations, malware, scraping, spam, security circumvention, fraudulent use, sanctions or import/export violations, or other unlawful conduct.
Using the Site:
Use the website lawfully. No hacking, scraping, spam, malware, or misuse.
Orders, Pricing, and Corrections:
Listings, prices, taxes, availability, dimensions, colours, transit times, provenance references, and other details may contain typographical errors, inaccuracies, or omissions. The Gallery may correct, update, or cancel orders where inaccurate information materially affects a transaction, subject to applicable law and any accepted sale document.
Orders and Errors:
Prices and details may change. Clear errors may be corrected before completion.
Products, Images, and Warranties:
Descriptions, images, colour, tone, dimensions, frame details, condition notes, and related information are provided in good faith for identification and general reference. Digital displays may not show every feature or condition issue. Except as expressly stated in a Bill of Sale, quote, invoice, appraisal engagement, or other written agreement, products and services are provided as-is to the fullest extent permitted by law.
Descriptions:
Descriptions help identify items, but screens vary and written agreements control specific promises.
Payment, Release, Title, and Risk:
Unless a specific written agreement states otherwise, artwork will not be released, packed, picked up, delivered, transferred, or shipped until all amounts owing have been paid in full and the funds have cleared. The Gallery may require identification, order references, delivery authorization, shipping authorization, insurance election, or other verification before release to a purchaser or any third party.
Release:
Artwork is released only after full cleared payment unless a written agreement says otherwise.
Third-Party Tools and Providers:
The Site may use or link to Shopify, payment processors, shipping providers, analytics providers, maps, social-media tools, embedded applications, insurers, couriers, appraisers, framers, conservators, and other third-party providers. Their services may be subject to their own terms and privacy practices, and use of those services is at your own risk.
Third Parties:
Shopify, carriers, and other outside providers have their own rules.
Submitted Materials and User Content:
If you send comments, reviews, photos, documents, provenance materials, artist submissions, appraisal materials, or other content, you represent that you have the necessary rights and permissions to do so and that the materials are not misleading, unlawful, or infringing. You authorize the Gallery to use, store, review, reproduce internally, and process those materials for customer service, recordkeeping, shipping, insurance, legal review, appraisal review, consignment review, purchase inquiry, and related Gallery operations.
Your Content:
If you send us files or comments, you must have the right to do so, and we may use them to provide services and keep records.
Appraisals, Estimates, and Related Services:
Appraisals, estimates, valuations, collection documentation, and related services are professional opinions based on information available at the time of review. They are not guarantees of sale price, authenticity, insurability, investment outcome, tax treatment, or third-party acceptance. Remote reviews based only on photographs or client-supplied information are preliminary unless confirmed otherwise in writing. Fees, scope, intended use, deposits, cancellation terms, and permitted reliance are governed by the applicable engagement.
Appraisals:
An appraisal is an opinion, not a guaranteed future result. Photo-only reviews are usually preliminary.
Unauthorized Physical Submissions:
Do not ship, mail, courier, drop off, leave, or deliver artwork, photographs, certificates, frames, or other property to the Gallery for appraisal, review, consignment, sale, framing, conservation, photography, storage, or related services unless the Gallery has expressly authorized receipt in advance. Unauthorized submissions may be refused, returned, or held, and the sender or owner may be responsible for related costs, loss, damage, customs, brokerage, storage, handling, and return shipping.
Before Sending Items:
Do not send or drop off property unless we approved it first.
Provenance, Authenticity, and Questionable Property:
The Gallery may decline, pause, cancel, return, or seek further information where concerns arise about title, ownership, authenticity, attribution, provenance gaps, import/export compliance, sanctions, forgery concerns, stolen property, disputed ownership, or similar issues. Clients, sellers, consignors, and submitters must provide accurate information and disclose material facts that may affect review, service, or sale.
Red Flags:
If ownership or authenticity concerns arise, we may pause or stop the transaction.
Intellectual Property:
The Site and its content, including text, graphics, photographs, artwork images, artist biographies, documents, layouts, policies, forms, marks, logos, and software, are owned by or licensed to the Gallery or applicable rights holders and are protected by law. Purchase of artwork transfers ownership of the physical artwork only; copyright and related rights do not transfer unless expressly stated in writing.
Copyright:
Buying artwork does not automatically transfer copyright or reproduction rights.
Privacy, Confidentiality, and Records:
Personal information submitted through the Site, forms, email, appraisal intake, or service requests is governed by the Privacy Policy and applicable law. The Gallery may use and retain information and submitted materials for transactions, services, communication, fraud prevention, legal compliance, dispute response, and internal operations, and may share information with appropriate staff and service providers where necessary.
Privacy:
We use information to run purchases and services and to meet legal and operational obligations.
Gift Certificates and In-Store Credit:
Gift Certificates may only be used in the currency in which they are issued. They cannot be exchanged for a different amount or currency and cannot be cancelled once issued except if voided by an authorized officer of West End Gallery Ltd. Products purchased with a Gift Certificate remain subject to the applicable Return & Exchange Policy and any Bill of Sale.
Gift Cards:
Gift cards follow their own rules, and the item purchased still follows the applicable policy.
Artwork on Approval:
Artwork may be taken on approval only with Gallery approval and on the terms accepted by the Gallery. Approval transactions should be documented in a written approval agreement covering approval period, condition, security authorization, risk of loss, insurance, return deadline, and events that convert the approval into a sale. Unless otherwise agreed in writing, the approval period is two calendar days from release.
On Approval:
Approval is short-term and must follow a written approval agreement.
Shipping, Returns, and Exchanges:
Shipping, pickup, delivery, inspection, damage claims, insurance, customs, duties, returns, exchanges, and related matters are governed by the applicable Bill of Sale & Terms and Conditions, Shipping Policy, Return & Exchange Policy, quote, invoice, and any other written agreement issued by the Gallery. Except where required by law, original artwork sales are final and refunds are not provided.
Shipping and Returns:
Those topics are governed mainly by the Bill of Sale, Shipping Policy, and Return & Exchange Policy.
Liability, Indemnity, Severability, and Governing Law:
To the fullest extent permitted by law, the Site and services are provided as-is and as-available, and indirect, incidental, special, consequential, punitive, and similar damages are excluded. Aggregate liability for a purchase is capped at the amount paid for the specific product or service giving rise to the claim. You agree to indemnify the Gallery for claims arising from breach of these Terms, unlawful conduct, infringement, or misuse. Alberta law and applicable federal law govern these Terms, and Alberta courts have exclusive jurisdiction subject to non-waivable rights.
Liability and Disputes:
Liability is limited, and Alberta law governs these Terms.
Entire Agreement, Versioning, and Policy Changes:
These Terms and policies or operating rules posted on the Site or issued for a specific transaction form the entire agreement for Site use and general services, subject to any more specific written agreement. The policy version in effect should be tied to the relevant order date, service booking date, or agreement date unless law or a written agreement requires otherwise. We may update these Terms from time to time by posting the updated version on the Site.
Updates:
Policies may change, but a specific transaction is governed by the version that applied at the time.
