By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence, or that you are the age of majority in your province or territory of residence, and you have given us your consent to allow any of your minor dependents to use this site.

Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We have made every effort to display the colours and images of our products that appear at the store as accurately as possible. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. In our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address or phone number provided when the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that your comments will not violate any rights of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments will not contain libellous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

In no case shall West End Gallery Ltd., our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

Because some provinces or territories do not allow the exclusion or limitation of liability for consequential or incidental damages, in such provinces or territories, our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless West End Gallery Ltd. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising from your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms; such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services or when you cease using our site.

If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly, we may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this site or concerning the Service constitute the entire agreement and understanding between you and us and govern your use of the Service. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

Any ambiguities in the interpretation of these Terms shall be resolved in a manner that renders them enforceable and consistent with the parties’ original intent.

SECTION 18 - GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. If we make material changes to these Terms, we will notify you by email or by posting a notice on our website prior to the changes taking effect. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

SECTION 20 - GIFT CERTIFICATE TERMS OF SERVICE

General

By purchasing a West End Gallery Gift Certificate, you agree to comply with these terms and conditions.

Issue, Value, and Currency

  • A Gift Certificate may only be used in the currency in which it is issued. You cannot exchange a Gift Certificate for a different amount or currency.
  • Gift Certificates cannot be cancelled once they have been issued except if voided by an authorized officer of West End Gallery Ltd. or as required by applicable laws.
  • We reserve the right to correct the balance of a Gift Certificate if we believe that a clerical or accounting error has occurred.
  • Gift Certificates have no associated fees and do not expire.

Use and Redemption

  • Gift Certificates may only be used to purchase products from West End Gallery Ltd. Gift Certificates may also be applied against sales tax and shipping charges (where applicable).
  • To obtain the balance on a Gift Certificate, please contact our head office at 780.488.4892. Please have your Gift Certificate available.
  • You cannot use a Gift Certificate to purchase another Gift Certificate. Gift Certificates cannot be reloaded, resold, or used for payment outside of West End Gallery Ltd.
  • When you make a purchase using a Gift Certificate, the amount of the purchase will be deducted from the balance. Any remaining balance will remain on the Gift Certificate and can only be used to purchase West End Gallery products. If your purchase exceeds the balance on the Gift Certificate, you must pay the remaining amount with another payment method.
  • Once a Gift Certificate has been fully redeemed, it cannot be reused or reloaded.

Risk; Loss

  • Recipients are responsible for the safekeeping of the Gift Certificate.
  • To the fullest extent permitted by law, West End Gallery Ltd. makes no warranties concerning Gift Certificates, including any express or implied warranty of merchantability or fitness for a particular purpose. If a Gift Certificate is non-functional, we will replace it. Replacement Gift Certificates will not be issued for lost or stolen Gift Certificates or if it is degraded beyond legibility.

Fees, Charges, Cancellation, and Fraud

  • No fees apply to the use of Gift Certificates.
  • You agree that you will not use a Gift Certificate in a misleading, deceptive, or unfair manner.
  • Without notice to you, we reserve the right to cancel a Gift Certificate without a refund if we suspect that it was obtained or is being used or applied fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
  • We reserve the right to require additional identity verification or to request alternative forms of payment if we believe a Gift Certificate has been fraudulently obtained.

Exchanges

Products purchased using a Gift Certificate may be exchanged for in-store credit according to our Returns Policy.

  • Gift Certificates cannot be returned, resold, transferred for value, redeemed for cash, or applied to any other account except as required by law.

General

  • Gift Certificates may be used as personal or business gifts but may not be used in connection with any advertising, marketing, or other promotional activities. The use of Gift Certificates in any manner that states or implies any person is affiliated with or endorsed by West End Gallery Ltd. in any way is strictly prohibited.

SECTION 21 - ARTWORK ON APPROVAL SYSTEM

  • Approval Period: Clients may take artwork on approval for a period of two days. The approval period begins on the day the artwork is collected from West End Gallery Ltd.
  • Security: Before taking artwork for approval, clients must provide a valid credit card authorization as security. No charges will be made to the credit card unless the artwork is not returned within the specified approval period or is returned damaged.
  • Return Condition: Artwork taken on approval must be returned in the same condition as when it was collected. Any damage or alteration to the artwork while on approval will result in the client being charged the full purchase price of the artwork.
  • Purchase Decision: If the client decides to purchase the artwork during the approval period, the credit card provided will be charged the full purchase price, and the sale will be finalized.
  • Return of Artwork: If the client decides not to purchase the artwork, it must be returned to West End Gallery Ltd. by the end of the approval period. Failure to return the artwork within the specified period will result in the client’s credit card being charged the full purchase price of the artwork.
  • Risk and Insurance: While the artwork is on approval and in the possession of the client, the risk associated with the artwork passes to the client. Clients are advised to insure the artwork for its full value during the approval period.
  • Ownership: Title and ownership of the artwork remain with West End Gallery Ltd. and the artist throughout the approval period unless the client purchases the artwork.

SECTION 22 - ART APPRAISAL TERMS

Terms of Service for Appraisals

  1. Overview
    West End Gallery Ltd. provides appraisal services, including Verbal, Standard, and Enhanced Appraisals. By requesting an appraisal, you agree to the terms outlined below. These terms are subject to change, and it is the client’s responsibility to stay informed of any updates
  2. Service Agreement
    When requesting an appraisal from West End Gallery Ltd., you agree to pay for the appraisal services according to the rates presented at the time of service. Payment is due at the time of booking unless otherwise agreed. All fees for appraisals, whether verbal or written, are non-refundable once the service is rendered.
  3. Verbal Appraisal
    Verbal appraisals are conducted during in-person visits or over the phone. They provide an estimated value of the artwork but do not include formal documentation. The fee for a verbal appraisal is $50.
  4. Standard Appraisal
    The Standard Appraisal service includes a formal document with replacement value for the items appraised. Each item is charged $15 for its individual replacement value assessment. Digital photography, secondary market analysis, and condition reports are not included but can be added for an additional fee (see A La Carte section). The cost of the Standard Appraisal is $175 per hour.
  5. Enhanced Appraisal
    The Enhanced Appraisal includes all features of the Standard Appraisal with added benefits: digital photography, secondary market analysis, and condition reports are all included in the service. The Enhanced Appraisal costs $250 per hour and $75 per item.
  6. In-Person Request (On-Site Visit)
    On-site appraisals are available for a minimum charge of $300 (1.5 hours), with $150 per additional half-hour. A travel fee of $150 applies within a 20-minute radius of Edmonton, AB, with increased rates for longer distances or multiple locations ($150 per additional location). In-person appraisals include the services offered in the Standard Appraisal.
  7. Client Responsibilities for On-Site Appraisals. Clients must provide and not limited to:
    • A clean, safe, and smoke-free environment.
    • Clear access to artwork at ground level.
    • Items that require a step stool or ladder must be moved by the client prior to the appraiser’s arrival.
    • Ensure that any artwork improperly hung or displayed is secured. The appraiser will not rehang or adjust artwork.
  8. Cancellation Policy
    Appointments cancelled with less than 24 hours’ notice will be subject to a $150 cancellation fee. If the appraiser arrives on-site and the client is not present or the environment is unsafe, the full travel fee will be charged.
  9. Limitation of Liability
    The appraiser is not responsible for fluctuations in market value, third-party valuations, or other conditions beyond the appraiser’s control. All appraisals are based on available market data and professional expertise. West End Gallery Ltd. cannot be held liable for any discrepancies in valuations or subsequent claims related to the appraised items
  10. Insurance Compliance
    For insurance purposes, digital photography may be required for high-value items. This is necessary to ensure accurate representation and documentation for the insurance provider.
  11. Refund Policy

Appraisal services are non-refundable. Should an error in documentation be identified within 7 days, it will be corrected at no additional cost.

Gift Certificates

  • Our Gift Certificates don’t expire and have no fees.
  • They’re only for buying art from us.
  • Keep them safe—we can’t replace lost or stolen ones.
  • You can’t use them to buy other Gift Certificates or redeem them for cash (unless the law says so).

Artwork on Approval

  • You can take artwork home for up to two days to see if it fits.
  • We’ll need a valid credit card authorization as security.
  • Please take good care of the art. If it’s damaged or not returned on time, we’ll have to charge you.

Art Appraisals

We offer appraisal services to value your art. There are different levels and fees:

  • Verbal Appraisal: Quick estimate for $50.
  • Standard Appraisal: Detailed document at $175/hour.
  • Enhanced Appraisal: Includes photos and more at $250/hour.

If we come to you, please make sure:

  • The place is clean and safe.
  • Artwork is accessible.
  • You let us know at least 24 hours in advance if you need to cancel, or there might be a fee.
